Some of the legally untenable clauses in the NGT orders indicate that Special courts and Tribunals have begun to act like Activists and not adjudicators. This also holds true of various Pollution Control Boards, Labour Commissioners, and Factory Inspectors, which have increasingly been taking pride in shutting down factories and establishments rather than help them comply with the laws and nudge them towards social and environmental responsibility. Clauses in the NGT ruling that came in for serious criticism and adverse remarks are as follows:<\/span><\/p>\n<\/div>\n<div class=\"article-main__content\" data-test-id=\"publishing-text-block\">\n<p>&nbsp;<\/p>\n<ul>\n<li><span class=\"italic\">The NGT had ordered an ED probe into a case of pollution caused by a firm.<\/span><\/li>\n<li><span class=\"italic\">A penalty of Rs 50 crores was imposed on the company with no reasoning given for this amount except that the turnover of the company was 550 crores. The quantum of damage to the environment was not mentioned.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<\/div>\n<div class=\"article-main__content\" data-test-id=\"publishing-text-block\">\n<p><span class=\"\">The Supreme trashed the NGT\u2019s 145-page order with a terse remark,\u00a0<\/span><span class=\"font-[700]\">\u201cApplication of mind not proportionate to the number of pages.\u201d<\/span><\/p>\n<\/div>\n<div class=\"article-main__content\" data-test-id=\"publishing-text-block\">\n<p><span class=\"\">I have seen such activism first hand as it plays out destroying industries and jobs, setting the country back with each such act bordering on obstruction and sabotage<\/span><\/p>\n<\/div>\n<div class=\"article-main__content\" data-test-id=\"publishing-text-block\">\n<p><span class=\"\">While working as the Divisional Railway Manager of Salem, Tamil Nadu, During my interaction with a Chamber of Industries in Karur (Tamil Nadu) I came across the President of the Truck and Bus Body Builders&#8217; Association, people who build buses and lorries on bare chassis.<\/span><\/p>\n<\/div>\n<div class=\"article-main__content\" data-test-id=\"publishing-text-block\">\n<p><span class=\"\">I asked the gentleman how his business was doing. He said that the business was down. Upon being asked the reason an alarming story of de-industrialization and de-employment unfolded like layers of an onion. \u00a0It went on like this:<\/span><\/p>\n<\/div>\n<div class=\"article-main__content\" data-test-id=\"publishing-text-block\">\n<p>&nbsp;<\/p>\n<ol>\n<li><span class=\"italic\">Bus body building was down since fewer buses were being brought into service.<\/span><\/li>\n<li><span class=\"italic\">The demand for buses had fallen since the number of intra-city travelers and commuters from nearby villages had come down.<\/span><\/li>\n<li><span class=\"italic\">Number of commuters had come down since the textile and garment industry in the famous Coimbatore-Tiruppur-Erode-Karur area was in decline.<\/span><\/li>\n<li><span class=\"italic\">The textile industry was in decline since they were being priced out in the market.<\/span><\/li>\n<li><span class=\"italic\">Their prices had gone up since they now had to send their fabric to Rajasthan for dying, which added to their costs. Trucking from Tamil Nadu to Rajasthan and back, attendant handling costs and managerial time was pushing them out of business.<\/span><\/li>\n<li><span class=\"italic\">They were forced to send the cloth all the way to Rajasthan since the TN State Pollution Control Board decided, one fine day, that the dying industry in the world-famous textile belt of the State was a polluting industry. All the dying units were forced to shut down almost overnight sending thousands of labourers into unemployment and misery.<\/span><\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<\/div>\n<div class=\"article-main__content\" data-test-id=\"publishing-text-block\">\n<p><span class=\"\">It appeared that most states in India were shutting down textile dying industry on account of pollution. They seemed to ignore that dying was an essential activity in the chain of textile manufacture and finishing. Government&#8217;s intervention was required to ensure that it was done in environment-friendly ways and not to shut down the industry.<\/span><\/p>\n<\/div>\n<div class=\"article-main__content\" data-test-id=\"publishing-text-block\">\n<p><span class=\"\">I asked the people around what they would do when Rajasthan also shut down its dying industry, which was eventually inevitable given the shortsightedness of our government agencies, which increasingly work more like activists than enablers.<\/span><\/p>\n<\/div>\n<div class=\"article-main__content\" data-test-id=\"publishing-text-block\">\n<p><span class=\"font-[700]\">They said, &#8220;We will stop manufacturing, import Chinese or Bangladeshi fabric and trade in it.&#8221;\u00a0<\/span><\/p>\n<\/div>\n<div class=\"article-main__content\" data-test-id=\"publishing-text-block\">\n<p><span class=\"\">So, the writing on the wall in the state was clear &#8211; a few lakh artisans would lose their jobs and their families thrown into penury. It may happen in the short span of a few years.\u00a0Since factories will close, they will also have surplus electricity. So, they can also shut down some power plants making the air even cleaner and create some more joblessness.\u00a0<\/span><\/p>\n<\/div>\n<div class=\"article-main__content\" data-test-id=\"publishing-text-block\">\n<p><span class=\"\">Soon, the artisans will either migrate to menial labour or, in any case, lose their traditional skills due to disuse. Our economic slavery to China will be complete.
