The Pakistani Supreme Court judgement that has disqualified Nawaz Sharif is remarkable for several reasons. This is the second time the court has dismissed a sitting Prime Minister. Yusuf Raza Gilani was the first in 2012. However, if you include the Court\u2019s order to arrest his successor Raja Pervez Ashraf–although he survived in office– it\u2019s the third time the country\u2019s Supreme Court has targeted a sitting head of government.<\/u><\/u><\/span><\/p>\n

<\/u>\u00a0<\/u><\/p>\n

Clearly, the Pakistani Supreme Court has established its independence as well as its power in a political system where most authority lies with the army, although the Prime Minister is considered the chief executive. This is a remarkable achievement.<\/u><\/u><\/p>\n

<\/u>\u00a0<\/u><\/p>\n

However, in this specific instance the judgement of the Pakistani Supreme Court has also raised worrying concerns. They need to be borne in mind before we form a firm opinion about yesterday\u2019s outcome as well as Nawaz Sharif\u2019s future.<\/u><\/u><\/p>\n

<\/u>\u00a0<\/u><\/p>\n

First, Sharif was unseated because the court deemed him to be in breach of Articles 62 and 63 of the Pakistani constitution. Article 62 requires the PM to be \u201csadiq\u201d (truthful)\u00a0 whilst\u00a0 Article 63 stipulates he should be \u201cameen\u201d (righteous). As one of the judges on the five judge bench, Ejaz Afzal Khan,\u00a0 told Reuters, Sharif was no longer \u201celigible to be an honest member of Parliament.\u201d\u00a0 <\/u><\/u><\/p>\n

<\/u>\u00a0<\/u><\/p>\n

The only case the court has is that Sharif did not disclose a salary he never received as chairman of a Dubai-based company called Capital FZE, but\u00a0 was entitled to, as an asset in his nomination papers in 2013. Sharif argued that an unreceived salary is not an asset. The court disagreed.\u00a0 But is this small and technical ground sufficient to deem a sitting Prime Minister ab initio\u00a0\u00a0 dishonest and unrighteous? <\/u><\/u><\/p>\n

<\/u>\u00a0<\/u><\/p>\n

The glaring paradox is that the substantial charge against Sharif is one of corruption. As far as that\u2019s concerned, the Supreme Court has referred the matter to the National Accountability Bureau and asked it to file criminal charges. This means\u00a0 the original charge of corruption has yet to be proved\u2014and, conceivably,\u00a0 may never be\u2014but the Prime Minister has already been found on technical grounds to be dishonest and unrighteous. This is not just disconcerting, it doesn\u2019t feel like full and proper justice. <\/u><\/u><\/p>\n

<\/u>\u00a0<\/u><\/p>\n

However, that\u2019s not all. The five judge bench that unseated \u00a0Sharif comprised two judges who in april had concluded he should be dismissed on the basis of the\u00a0 Joint Investigation Team report. For some this was a second big shock. To understand why we need to go back to what happened in april.<\/u><\/u><\/p>\n

<\/u>\u00a0<\/u><\/p>\n

At that time, when a five judge bench found 3-2 in Sharif\u2019s favour, an implementation bench comprising the 3 judges who supported Sharif was set up to examine and form an opinion on the JIT report. The two judges who had found against him were not part of this bench. <\/u><\/u><\/p>\n

<\/u>\u00a0<\/u><\/p>\n

Thereafter, from April till now, whenever lawyers debated and dissected the JIT report it was done in front of the three judges comprising the implementation bench. The other two had no role to play. But, suddenly, on thursday night it was announced that a five judge beach would deliver the verdict. At the last moment the other two judges had been brought back into the picture. This seemed to load the dice against Sharif and raised suspicion. <\/u><\/u><\/p>\n

<\/u>\u00a0<\/u><\/p>\n

Third, the Chief Justice was not part of this five judge bench. No doubt he\u00a0 chose not to be (because some consider him a Sharif supporter) and,\u00a0 more over, his participation was not essential, but, equally, his absence is striking and strange. Ordinarily, in such a critical matter one would expect the Chief Justice to preside.<\/u><\/u><\/p>\n

<\/u>\u00a0<\/u><\/p>\n

In fact, concerns about the procedure by which the court conducted the Sharif case go further. The JIT it appointed included representatives from military intelligence and the ISI. Why? A proper explanation has never been given.<\/u><\/u><\/span><\/p>\n

<\/u>\u00a0<\/u><\/p>\n

Secondly, the JIT was asked to look into a vast volume of financial information, both from within Pakistan and other countries, spanning over three decades, in just eight weeks. At least some people believe this was so difficult a task it could hardly be done properly or fairly. <\/u><\/u><\/span><\/p>\n

<\/u>\u00a0<\/u><\/span><\/p>\n

Finally, in the past judges of the Pakistani Supreme Court have bent their views to suit the interest of the country\u2019s military rulers. The most famous instance of this is the validation of martial law on the basis of what\u2019s called the doctrine of necessity. Today there may well be a few who ask if there are hints of this happening again. It may be an unkind question but in the circumstances is it really unreasonable? <\/u><\/u><\/span><\/p>\n

<\/u>\u00a0<\/u><\/p>\n

None of this, of course, exonerates Mr Sharif and his family. It\u2019s even possible he will be found corrupt and, therefore, dishonest and unrighteous. But justice is as much about procedure and fairness as it is about the verdict.
