Shri Kejriwal & Manish Sisodia’s Threatened Boycott Of High  Court Is An Attack On The Foundation Of Our Nationhood Rajiv Upadhyay Shri Kejriwal and Manish Sisodia have decided to boycott High Court hearing on liquor case because of presence of Justice  Swarana  Kanta Sharma on the bench as judge . Kejriwal wanted her exclusion as he thought he will not get a fair hearing with her in bench . Justice Swarna Kanta in a 115 page judgement explained her position quite well . A small question in this case is whether a litigant can judge a Judge ? Supreme / High Court Judges go through a very strong selection system . They have their opinions too as brought out very strongly by Justice V K Aiyar in his landmark judgement on death penalty . But Chief Justice constitutes a bigger bench when larger issues are involved . In this case too he will decide the size of the bench . It is the collective opinion of the judges that will decide the case . This is a universal practice. So the system takes care of individuality of judges . Litigants cannot be given the right to choose the judge as it will make a mockery of the judicial system . But beyond the legal issue this is a very dangerous precedent being created by a person who once threatened to disrupt 26 th January parade as chief minister and who cut electricity wires on poles to protest against bills . He spoilt forever Indian politics by ‘Rewari’ culture which has now become the new norm in electoral politics . But beyond that this move has done a far reaching damage to our very nation hood . All type of disputes including inter river water disputes , States vs Centre disputes , Ayodhya type disputes have a common governing clause ie let Supreme / High  Court decide . Once we politicise judiciary by street agitations the real beneficiaries will be the terrorists , separatists , big criminals , foreign intelligence agencies . Because if not Supreme / High Court than who else can judge . You destroy the very foundation of constitution . By and large in spite of many aberrations , our judicial system has delivered and judgements are often speaking orders giving insight into the reasoning . There is a provision for appeal in form of revision petition . There was the famous case of ban on Jallikattu in 2014 which Jayalalitha too opposed . Finally an ordinance was passed reversing High Court Judgement which was supported by Supreme Court too. . Diwali Patakhas ( crackers ) were another area where public was very much against Supreme Court but leaders exercised restraint in larger national interests . But a Satyagrah against Supreme Court in a criminal case is playing directly into anti national forces . It will unleash forces that nation cannot control including communal riots , sabotage , terror attacks etc . Government and Supreme / High Court should follow the law and if the duo has to be freed or jailed, it should be done by appointing a lawyer to defend in absentia and completing the hearing in absentia. Artemis After Apollo; The New American Lunar Mission : क्या चाँद पर भी अमरीकी बादशाहत होगी : भारत कहाँ है ? राजीव उपाध्याय 10 अप्रेल की  रात को अमरीकी आर्टेमिस – २ अन्तरिक्ष विमान चाँद का चक्कर लगा कर प्रशांत महासागर मैं गिर गया और उसके चारों यात्री सुरक्षित निकल लिए गए . प्रश्न यह है कि अमरीका का नासा तो अपोलो  के तहत सन 1969  मैं ही चाँद पर मानव भेज  चुका था   और उसके बाद उसने 5 और  मिशन मैं १२ यात्री चाँद पर  पर  उतारे थे और वहां की चट्टान भी पृथ्वी पर ले आया था . तब १९७२ मैं खर्चीला होने के कारण उसे बंद कर दिया गया था . तो अब जब अमरीका की आर्थिक स्थिति और ख़राब है तो वह क्यों आरटेमिस मिशन को पुनः जीवित कर दिया है और इसमें क्या नया है ? आर्टेमिस – १   २०२२ मैं गया था और चाँद का चक्कर लगा कर आ गया . अब आर्टेमिस -२ मैं मानव अतरिक्ष यात्री चाँद का चक्कर लगा कर बिना उतरे वापिस आ गए .अरतिमिस – ३ पृथ्वी की Low orbit मैं एलोन मस्क की कंपनी के स्पेस स्टेशन मैं लोग भेजेगा . अरतिमिस – ४ २०२८ मैं चाँद पर पुनः मानव यात्री उतारेगा . २०३३ मैं पूरी अन्तरिक्ष कालोनी बना ली जाएगी . अमरीका के अलावा , यूरोप , कनाडा , ऑस्ट्रेलिया , जापान , इटली भी इसमें जुड़ेंगे . अमरीका अब चाँद पर अपनी कालोनी बनाना चाहता है जहाँ लगातार अमरीकी लोग रहेंगे और वैज्ञानिक परिक्षण करेंगे . इसके लिए वह एक नए बड़े और अत्यधिक शक्तिशाली राकेट  को बना रहा है .चाँद पर जाने के लिए एलोन मस्क और अमेज़न की कंपनियां राकेट बनाएंगी . वहाँ  पर ड्रोन उडाये जायेंगे . बिजली के लिए एक परमाणु बिजली घर बनाया जाएगा .चाँद की रात बहुत ठंडी होती है . उसका सामना करने की तकनीक विकसित की जायेगी . अंत मैं चाँद पर रह कर मंगल गृह पर जाने कि तकनीक भी विकसित की जायेगी. वहां के खनिज पदार्थों का अध्ययन किया जाएगा . इस तरह चाँद पर भी पश्चिमी देशों का बोलबाला होगा . चीन भी २०३० तक अपना पहला  मानव यात्री वाला अन्तरिक्ष यां चाँद पर उतारेगा भारत अपने गगन यान  व चंद्रयान – ४ को आगे बढ़ा रहा है और 2027 मैं पहला मानव अन्तरिक्ष यात्री भेजेगा . २०४० तक अपना पहला अन्तरिक्ष  यात्री चाँद पर भेजने की तैयारी कर रहा है. अपने सीमित संसाधनों मैं भारत की पहल सराहनीय है . हम भी चीन की तरह अपनी वैज्ञानिक क्षमता को उपयोग मैं ला कर एक स्वाबलंबी अन्तरिक्ष कार्यक्रम चला रहे हें . अगर जापान या रूस इसमें हमारे लम्बे साथी बन जायेंगे तो शायद यह जल्दी भी हो जाये . परन्तु राष्ट्रपति ट्रम्प का मुख्य उद्देश्य अन्तरिक्ष मैं अमरीका को सिरमौर बनाए रखने का  है और अब नासा के अलावा स्पेस – एक्स और अमेज़न की ब्लू मून कम्पनी भी आगे आयेंगी. अमरीका अब अपनी नयी पीढी को वैज्ञानिक रिसर्च के लिए तैयार कर रहा है. भारत समेत बाकी विश्व भी इसमें आगे तो बढेगा पर अमरीकी शहंशाहत  को कोई चुनौती नहीं दे सकेगा . ...

क्या घायल पर स्वाभिमानी ईरान ही अंततः फिर विजेता हुआ : भारत के लिए भी सीख : स्वाभिमान व स्वतंत्रता की कीमत होती है मुफ्त नहीं मिलती राजीव उपाध्याय रूस के  युक्रेन के हमले की तरह ही इस बार अमरीका धोखा खा गया . उसने ईरान पर ३९ दिन पहले २८ फरवरी को पहले चढ़ाई कर दी , शायद इस धोखे मैं कि वह शायद एक सप्ताह मैं जीत जाएगा . शुरू मैं ही ईरान के सर्वोच्च नेता खामेनी की ह्त्या कर दी गयी . अमरीका व इजराइल को  आशा थी कि खामेनी व शीर्ष  नेत्रित्व को हटाते ही  लड़ाई खतम हो जायेगी जैसा सद्दाम व गद्दाफी  साथ हुआ था . पर ईरान मैं ऐसा नहीं हुआ . ईरान की सरकार  व जनता दोनों ने भरपूर ताकत से जबाब दिया और डट के मुकाबला किया . वह इस युद्ध के लिए पूर्णतः तैयार थे . पहले उस के हज़ारों सस्ते ड्रोन  आये और इसराईली  व अमरीका के बहुत मंहगे रक्षात्मक  इंटरसेप्मटर मिसाईलों को दीरे धीरे खर्च करवा दिया . फिर छोटी दूरी के मिसईलों से क़तर , दुबई , बहरीन और सऊदी अरेबिया के अमरीकी सैन्य अड्डों पर भीषण हमले लिए . इजराइल के आयरन डोम व एरो मिसाइलों की रक्षात्मक पंक्ती को छिन्न भिन्न कर तेल अवीव , हाईफा पर भी खूब मिसाईल हमले किये . अमरीकी उनके नेताओं को मारते गए पर इरानी इस के लिए तैयार थे और इसका युद्ध पर कोई प्रभाव एक नेता के मरते ही दुसरे ने जगह ले ली . जैसे ही अमरीका ने तेल संयत्रों पर हमला किया ईरान ने लम्बी दूरी की मिसाईलों से उसके एयरक्राफ्ट करियर अब्राहम लिंकन पर हमला कर दिया . अमरीका को सारे युद्ध पोत दूर ले जाने पड़े . इरान के मिसाइल घुमते हुए हमला करते थे और अमरीकी और इस्राईल के मिसाईल उनको  बिलकुल नहीं रोक पा रहे थे . अमरीका ने भीषण बमबारी की पर ईरान ने भी उसके मध्य एशिया मैं उसके सब सैन्य अड्डों कू तहस नहस कर दिया . अमरीका ने उसके परमाणु संयत्रों को ध्वस्त करने के लिए बंकर  बर्स्तर बमों को डाला पर इरान ने पहाड़ों मैं  बहुत गहराई मैं यूरेनियम छुपा रखा था . चालीस दिन मैं भी अमरीका कुछ नहीं ख़त्म कर पाया . इस्राईल की तो हालत बहुत खराब थी . उस ने बहुत मिसाईल रोके पर तब भी अनेकों मिसाइलों ने बहुत नुक्सान पहुंचाया . दोनों ने एक दुसरे की रेफिनरियों को भी काफी नुक्सान पहुंचाया . अंततः राष्ट्रपति ट्रम्प को अपनी दयनीय स्थिति समझ आ गयी , वह इरान को नहीं तोड़ पाए . उसके परमाणु कार्यक्रम को भी नहीं रोक पाए . कोई देश उनके साथ नहीं है . नाटो ने युद्ध मैं भाग लेने से मना कर दिया . अमरीकी सेना मैं भी इसका बहुत विरोध था . मंहगे तेल व गैस के कारण विश्व की जर्जर अर्थ व्यवस्था और चरमारा गयी .  ईरान ने होरमुज़ से जहाज़ों का आवा जाही पूरी तरह रोक दी . अब वह उस पर टोल लगाना चाह रहा है जिससे युद्ध के नुक्सान की भरपाई हो सके . अगर इसे मान लिया कल तुर्र्की   , मलेसिया , यमन भी अपने जलमार्गों पर टोल लगा देगे  . तो जिसको तिनका समझ रहे थे उस ईरान ने अमरीका को रुला दिया . अब उसके एक छत्र विश्व  नेत्रित्व के दिन लद  गए .चीन और साहसी हो जाएगा और ताइवान को हड़प कर लेगा . अमरीकी राष्ट्रपति ट्रम्प ने सब की लुटिया डुबो दी . बहुत चोट खा कर और बलिदान देकर भी इरान ने  अपने स्वाभिमान व स्वंत्रता की रक्षा कर ली . इस्राईल का भविष्य भी अब उज्जवल नहीं है . इरान उसकी जिन्दगी मुश्किल करता रहेगा . अब अरब देशों का दुस्साहस और बढ़ जाएगा . भारत के लिए इस युद्ध ने फिर दिखा दिया है कि स्वाभिमान और स्वत्न्र्ता के लिए कीमत अदा करनी पड़ती है . युरोप व भारत दोनों ने अपनी रक्षा को कभी उतना महत्व नहीं दिया जितना जरूरी थी . हमारी बाबूओं ने तो देश की रक्षा व्यवस्था को पूर्णतः जकड कर कुंठित कर रखा है . हम तब जागते हें जब पाकिस्तान किसी नई तकनीक लेकर हमसे आगे निकल जाता है . इस आग लगने के बाद कुआँ खोदने की आदत ने हम को एक सुस्त हाथी बना दिया है जिसे कोई भी भेडीयों का गुट  अपनी मर्जी  से काट लेता है . समय पर उच्च  रक्षा सामग्री नहीं खरीदने से कभी कोई  अभिनन्दन पकड़ा जाता है या रफल गिरा दिया जाता है . हम हर राज्या चुनाव के लिए नयी मुफ्त स्कीम शुरू कर देते हें और आवश्यक रक्षा उपकरण की खरीद टाल  दी जाती है. एक हवाई जहाज़ अपहरण हो जाता है और उसके परिजनों के आन्दोलन से सारी  सरकार डोल जाती है . हम क्या चोट झेलेंगे ! ईरान से हमें इसी का प्रतिकार सीखना चाहिए . दृढ निश्चय व पूर्ण तैयारी, साहस  और चोट झेलने व बलिदान की क्षमता  के बिना युद्ध नहीं जीते जा सकते . इतिहास गवाह है कि हमारे सैनिकों ने नहीं बल्कि नेतृत्व ने ही हमें  सदा हरवाया है . अब फिर किसी भी  हार के आगे फिर गुलामी खडी  है जिसके हम इतने अभ्यस्त हें भारत को इरान , युक्रेन व विएतनाम से बहुत कुछ सीखना है और जितना जल्दी सीख लें अच्छा होगा . ...
